SYSTEM USE DISCLAIMER

1. Scope of This Disclaimer
This System Use Disclaimer (this "Disclaimer") applies to all access to and use of the QikBIM platform, including the website located at www.qikbim.com, the QikBIM web portal located at app.qikbim.com, and all related applications, tools, and services (collectively, the "Services") provided by OFA Group, Inc., a company incorporated under the laws of the Cayman Islands ("OFA Group," the "Company," "we," "us," or "our"), and to all drawings, plans, models, schedules, documents, and other materials generated by the Services ("Outputs"). This Disclaimer is incorporated into and forms part of the QikBIM Terms and Conditions. By using the Services, you acknowledge and agree to this Disclaimer.
2. Nature of the System
QikBIM is an artificial intelligence-powered design-assistance system. Outputs are generated by computational models based on patterns learned from data and on the information you provide. Artificial intelligence systems are probabilistic in nature: they can and do produce results that are inaccurate, incomplete, internally inconsistent, non-compliant with applicable codes and standards, or otherwise erroneous, including errors that may appear plausible and professional in presentation ("hallucinations"). Outputs are limited to structures with a maximum of three (3) stories (ground plus two levels) and are subject to other technical limitations of the system. The Company does not review, verify, certify, stamp, seal, or approve any Output.
3. No Professional Services or Advice
THE SERVICES DO NOT PROVIDE ARCHITECTURAL, ENGINEERING, CONSTRUCTION, SURVEYING, CODE-COMPLIANCE, LEGAL, OR OTHER PROFESSIONAL SERVICES OR ADVICE, AND NO PROFESSIONAL-CLIENT RELATIONSHIP OF ANY KIND IS CREATED BY YOUR USE OF THE SERVICES. THE COMPANY IS NOT A LICENSED ARCHITECTURAL OR ENGINEERING FIRM, AND NO OUTPUT CONSTITUTES, OR SHOULD BE TREATED AS, AN INSTRUMENT OF SERVICE PREPARED, SIGNED, SEALED, OR CERTIFIED BY A LICENSED PROFESSIONAL.
4. Conceptual and Preliminary Nature of Outputs
All Outputs, including architectural drawings, elevations, sections, detailing, BIM models, structural drawings, reinforcement details, and material schedules, are conceptual, ideational, and preliminary work product intended solely to assist and accelerate the work of qualified professionals. Outputs are not construction documents, permit documents, or issued-for-construction drawings, and must not be used for bidding, permitting, fabrication, construction, or occupancy purposes unless and until they have been independently reviewed, verified, modified as necessary, and approved, signed, and sealed by architects, engineers, and other professionals duly licensed in the jurisdiction of the project, in accordance with all applicable laws and professional standards.
5. User Responsibility
You are solely responsible for: (a) evaluating the accuracy, completeness, suitability, and code compliance of all Outputs before any use; (b) engaging appropriately licensed professionals for all activities that require professional licensure under applicable law; (c) compliance with all applicable building codes, zoning ordinances, fire and life-safety requirements, energy codes, environmental regulations, and permitting requirements; (d) all site-specific conditions, including geotechnical, seismic, wind, flood, climatic, and other conditions that the Services cannot assess; and (e) all decisions made, and all actions taken or not taken, in reliance on the Services or any Output. Reliance on the Services or any Output without independent professional verification is at your sole risk.
6. No Warranty; Assumption of Risk
THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, RELIABILITY, CODE COMPLIANCE, BUILDABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL MEET YOUR REQUIREMENTS OR THE REQUIREMENTS OF ANY GOVERNMENTAL AUTHORITY. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICES AND ANY OUTPUT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY AND ITS AFFILIATES SHALL HAVE NO LIABILITY FOR ANY DESIGN ERRORS, CODE VIOLATIONS, CONSTRUCTION DEFECTS, PROJECT DELAYS, COST OVERRUNS, PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH ARISING FROM OR RELATED TO RELIANCE ON THE SERVICES OR ANY OUTPUT, AS FURTHER SET FORTH IN THE LIMITATION OF LIABILITY PROVISIONS OF THE TERMS AND CONDITIONS.
7. System Availability and Modifications
The Company may modify, suspend, or discontinue the Services or any feature thereof at any time, and does not guarantee that any particular feature, capability, or level of performance will remain available. Scheduled and unscheduled downtime, maintenance, and third-party service failures may interrupt access to the Services. You are responsible for maintaining independent copies of any Inputs and Outputs you wish to preserve.
8. Monitoring and Security Notice
Use of the Services may be monitored and logged for security, abuse-prevention, quality-assurance, legal-compliance, and service-improvement purposes, as described in the Privacy Policy and the Consent Agreement. Unauthorized access to or use of the Services, including any attempt to circumvent security or access controls, is prohibited and may result in suspension or termination of access and referral to law enforcement.
