PRIVACY POLICY

1. Introduction
This Privacy Policy describes how OFA Group, Inc., a company incorporated under the laws of the Cayman Islands, and its subsidiaries and affiliates (collectively, "OFA Group," the "Company," "we," "us," or "our") collect, use, disclose, and otherwise process personal information in connection with the QikBIM platform, including the website located at www.qikbim.com, the QikBIM web portal located at app.qikbim.com, and related applications and services (collectively, the "Services"). This Privacy Policy also describes your rights and choices with respect to your personal information.
By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. This Privacy Policy is incorporated into and forms part of our Terms and Conditions. Capitalized terms not defined herein have the meanings given in the Terms and Conditions.
2. Information We Collect
Information You Provide to Us. We collect information you provide directly, including:

Account Information: name, email address, password, company or firm name, professional role, and other registration details;

Payment Information: billing details processed by our payment processor, Stripe, Inc. We do not store full payment card numbers on our systems;

User Content: prompts, project parameters, design criteria, files, drawings, models, and other materials you submit to the Services ("Inputs"), and the drawings, plans, models, schedules, and other materials the Services generate in response ("Outputs");

Communications: information you provide when you contact us, including at support@qikbim.com, respond to surveys, or otherwise communicate with us.
Information We Collect Automatically. When you use the Services, we and our service providers automatically collect certain information, including:

Usage Data: pages viewed, features used, buttons and links clicked, commands issued, session duration, and interactions with the Services;

Device and Log Data: IP address, browser type and version, operating system, device identifiers, referring URLs, and date/time stamps;

Approximate Location Data: general location inferred from your IP address or provided device signals;

Cookies and Similar Technologies: data collected through cookies, pixels, local storage, and similar technologies, including those deployed by our website platform provider, Wix.com Ltd. ("Wix"). You can manage cookies through your browser settings and, where available, through cookie preference tools on the Services.
Information from Third Parties. We may receive information about you from third-party services and business partners, including our hosting, analytics, and payment providers, and combine it with information we collect directly.
3. How We Use Information
We use personal information for the following purposes:

To provide, operate, maintain, and secure the Services, including processing Inputs and generating Outputs;

To develop, improve, and train the Services and our underlying artificial intelligence models and technology, subject to the Consent Agreement and applicable law;

To detect, investigate, and prevent fraud, abuse, security incidents, and violations of our Terms and Conditions and other policies;

To comply with legal obligations, respond to lawful requests, and establish, exercise, or defend legal claims;

To send marketing communications where permitted by law, subject to your right to opt out; and

For any other purpose disclosed to you at the time of collection or with your consent.
4. Legal Bases for Processing
Where the European Union or United Kingdom General Data Protection Regulation ("GDPR") or similar laws apply, we process personal information on the following legal bases: (a) performance of a contract, where processing is necessary to provide the Services under our Terms and Conditions; (b) legitimate interests, including operating, securing, and improving the Services, provided such interests are not overridden by your rights and freedoms; (c) compliance with legal obligations; and (d) consent, where required, which you may withdraw at any time without affecting the lawfulness of processing before withdrawal.
5. How We Disclose Information
We may disclose personal information as follows:

Service Providers: to vendors and service providers that perform services on our behalf, including Wix (website hosting and infrastructure), Stripe (payment processing), and providers of cloud hosting, analytics, communications, and security services, in each case subject to appropriate contractual protections;

Affiliates: to our corporate affiliates and subsidiaries for purposes consistent with this Privacy Policy;

Legal and Safety: to comply with applicable law, regulation, legal process, or governmental request; to enforce our Terms and Conditions and other agreements; and to protect the rights, property, or safety of the Company, our users, or others;

Business Transfers: in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our business or assets; and

With Your Consent: with your consent or at your direction.
We do not sell personal information for money. If any of our disclosures constitute a "sale" or "sharing" of personal information under applicable law, you may exercise your opt-out rights as described in Section 10.
6. Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide the Services, comply with legal, accounting, or reporting obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the type of information, the purposes of processing, and applicable legal requirements. When personal information is no longer needed, we will delete, de-identify, or anonymize it in accordance with applicable law.
7. Security
We implement reasonable administrative, technical, and organizational measures designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly of any suspected unauthorized access.
8. International Data Transfers
The Company is incorporated in the Cayman Islands with operations in the United States, and personal information may be processed and stored in the United States and other jurisdictions that may not provide the same level of data protection as your home jurisdiction. Where required by applicable law, we implement appropriate safeguards for cross-border transfers, such as standard contractual clauses approved by relevant authorities. By using the Services, you acknowledge that your information may be transferred to and processed in such jurisdictions.
9. Your Rights and Choices
Depending on your jurisdiction, you may have some or all of the following rights with respect to your personal information: (a) to access and receive a copy of your personal information; (b) to correct inaccurate or incomplete personal information; (c) to delete your personal information; (d) to restrict or object to certain processing; (e) to data portability; (f) to withdraw consent where processing is based on consent; and (g) to lodge a complaint with a supervisory or data protection authority. We may need to verify your identity before responding to your request, and we will respond within the timeframes required by applicable law. We will not discriminate against you for exercising your rights.
Marketing Choices. You may opt out of marketing emails by following the unsubscribe instructions in those emails or by contacting us. We may still send you non-promotional communications regarding your account and the Services.
10. Additional Disclosures for U.S. State Residents
Residents of California and certain other U.S. states have specific rights under state privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act ("CCPA/CPRA"). In the preceding twelve (12) months, we have collected the categories of personal information described in Section 2, including identifiers, commercial information, internet or other electronic network activity information, approximate geolocation data, professional or employment-related information, and inferences drawn from the foregoing, for the purposes described in Section 3, and disclosed them to the categories of recipients described in Section 5.
Subject to applicable law, state residents may have the right to: (a) know and access the personal information we collect; (b) delete personal information; (c) correct inaccurate personal information; (d) opt out of the "sale" or "sharing" of personal information and certain targeted advertising; (e) limit the use of sensitive personal information; and (f) not receive discriminatory treatment for exercising these rights. You may exercise these rights by contacting support@qikbim.com. You may designate an authorized agent to make requests on your behalf, subject to verification requirements. We honor opt-out preference signals, such as the Global Privacy Control, where required by applicable law.
11. Children’s Privacy
The Services are intended for professional and business use and are not directed to children under the age of eighteen (18). We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without appropriate consent, we will take steps to delete such information promptly. If you believe a child has provided us with personal information, please contact us at support@qikbim.com.
12. Automated Processing and Artificial Intelligence
The Services use artificial intelligence and machine learning to process Inputs and generate Outputs. Inputs and usage data may be reviewed by authorized personnel and automated systems for purposes of safety, abuse prevention, quality assurance, and service improvement, and may be used to develop and improve our models and technology as described in this Privacy Policy and the Consent Agreement. You should not submit Inputs containing sensitive personal information, or personal information of third parties for which you lack a lawful basis. The Services do not make legally significant decisions about individuals based solely on automated processing.
13. Do Not Track
Some browsers transmit "Do Not Track" signals. Because there is no common industry standard for interpreting such signals, the Services do not currently respond to them, except that we honor recognized opt-out preference signals where required by applicable law as described in Section 10.
14. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy on the Services, updating the Effective Date above, and/or providing additional notice as required by applicable law. Your continued use of the Services after the updated Privacy Policy becomes effective constitutes your acknowledgment of the updated policy.
