System Usage Disclaimer and Consent Agreement
1. Acceptance of Terms
By accessing, using, or participating in the QikBIM platform (“System”), you acknowledge that you have read, understood, and agreed to the terms of this System Usage Disclaimer and Consent Agreement (“Agreement”). If you do not agree, you must not use the System.
2. Purpose of the System
The System is designed to assist users with architectural design and related functions by applying artificial intelligence and digital automation technologies. It is intended for professional use and pilot testing purposes only and should not be considered as a final substitute for human expertise or regulatory compliance.
3. No Warranty and Limitation of Liability
The System is provided on an “as is” and “as available” basis.
OFA makes no warranties, express or implied, regarding accuracy, completeness, or reliability of outputs.
Users agree that OFA shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the System, including but not limited to design errors, project delays, or cost overruns.
4. User Responsibility
Users remain fully responsible for reviewing, validating, and approving all System outputs before relying on them for professional or commercial purposes.
Users must comply with applicable laws, industry standards, and regulations when applying results generated by the System.
5. Data Usage and Privacy
By using the System, you consent to the collection and processing of data input for the purpose of improving the System’s functionality and performance.
Data will be handled in accordance with OFA’s Privacy Policy. Sensitive or confidential information should not be uploaded unless explicitly permitted.
6. Intellectual Property
All intellectual property rights in and to the System, including its software, models, and algorithms, remain the exclusive property of OFA. This Agreement does not grant users any ownership rights.
7. Consent to Participation in Pilot Program
If you are participating in the pilot program, you expressly consent to OFA using your feedback, usage patterns, and performance data to refine and enhance the System.
8. Disclaimer Regarding Media and Promotional Materials
In the event of any discrepancies between the actual functionality or performance of the System and descriptions, claims, or representations made in media, advertising, or promotional materials, the actual System functionality shall prevail. Users acknowledge and agree that OFA shall bear no liability for reliance on promotional content that differs from the System’s real-world use.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which OFA is incorporated, without regard to conflict of law provisions.
10. Acknowledgement
By continuing to use the System, you confirm that you have read, understood, and voluntarily accepted this Agreement, and that you consent to be bound by its terms.
